1. The Subject Of The Order Is The Performance Of Construction Works For The Task Entitled: English Park At Wał Gocławski - Time For The Next Step. More Trees, Flowers, Benches And Baskets. The Investment Is Located On Plot No. 2 From The 3-06-03 Precinct And Plot No. 5 From The 3-01-24 Precinct, A Green Area Between Ul. Gen. T. Bora-Komorowski And Ul. Wał Miedzeszyński In Warsaws Praga-Południe District. The Goal Is To Add New Sections Of Park Paths And Install Small Architecture Elements - Additional Toys At The Existing Playground, Bicycle Racks, Benches, Waste Bins And Hybrid Lanterns. The Investment Is Carried Out Within The Framework Of The Civic Budget.2. For Economic Reasons, The Investment Was Divided Into Two Guaranteed And Optional Tasks: 1) Basic Order (Guaranteed): A) Preparatory Works, I.E. Securing The Construction Site - Occupational Health And Safety, Securing Trees, Preparing A Bioz Plan, Preparation Of Facilities, Geodetic Marking. B) Cleaning Works, I.E. . Removal Of Reinforced Concrete Elements, Removal Of Two (Small) Hills On The Playground. C) Construction Of A Mineral Path With Substructure And Steel Edges. D) Purchase, Delivery And Installation Of Equipment (To Retrofit The Playground), I.E. Tunnel, Scale Set , Stairs, A Platform At The Slide And Supplementation Of A Safe Gravel Surface.E) Purchase, Delivery And Installation Of A Device, I.E. A Rope Slide, And Construction Of A Safe Sand Surface.F) Purchase, Delivery And Installation Of Small Architecture Elements, I.E. Park Benches With Backrests, Baskets For Garbage And Bicycle Racks. G) Preparation Of As-Built Documentation, Including Obtaining A Certificate Of Post-Assembly Inspection Confirming The High Safety Of The Playground, Referred To In The Contract Template In § 3 Section 2 Point 16 And 17 And An As-Built Drawing Of The Playground Development. 2) Optional Order - Option Right: Purchase, Delivery And Installation Of Hybrid Lanterns Along With The Preparation Of As-Built Documentation. 3. The Scope Of Work To Be Performed Includes All Work That Must Be Performed So That The Completed Elements Fulfill The Intended Function And Those That Result From The Technology Of Work, Construction Practice, Construction Law Provisions, Even If They Were Not Separately Described In The Technical Specification Of Execution And Acceptance Works, Along With The Removal Of All Defects And Defects Related To The Execution Of The Works.4. The Contractor Declares That: A. Got Acquainted With The Area, Technical Conditions For The Implementation Of The Subject Of The Contract And Technical Documentation - Verified The Bills Of Quantities With The Actual Condition And Technical Documentation, Checked Them And Does Not Raise Any Objections To Their Compliance And Completeness, B. Documentation As Above Considers It A Sufficient Basis For The Implementation Of The Subject Of The Contract, C. Will Provide An Offer Cost Estimate On The Date Of Conclusion Of The Contract, Constituting Annex No. 2 To The Contract.5. The Ordering Party Reserves That The Part Of The Order Defined As The Option Right Is An Entitlement, Not An Obligation, Of The Ordering Party. The Ordering Party May Not Exercise The Option Right Or Use It To A Lesser Extent, In Particular If It Fails To Obtain Financial Resources For This Purpose, And The Contractor Is Not Entitled To Any Claims In This Respect, To Which The Contractor Consents And Accepts The Conditions Specified In The Contract And Documentation Tender.6. Notification Of The Exercise Of The Option Right Will Be Presented To The Contractor In Writing, Delivered In Person Or Electronically (Scan Of The Letter Attached To The E-Mail), No Later Than 2 Weeks From The Date Of Conclusion Of The Contract. 7. The Cost Of Remuneration For The Selected Scope Of Optional Works Is Specified In The Offer Cost Estimate Constituting Annex 2 To The Contract.8. If The Ordering Party Exercises The Option Right, The Contractor Is Obliged To Implement It, Under The Conditions Specified In The Contract, Tender Documentation And The Offer Prepared By The Contractor.3) Additional Information1) The Ordering Party Recommends Carrying Out A Local Inspection Of The Investment Area (Provisions In The Contract Template § 1 Section 4 Point 1). 2) The Contractor Is Obliged To Attach A Technical Card And A Current Certificate Of The Rope Descent Set To The Offer. 3) The Contractor Is Obliged To Present To The Ordering Party Technical Cards, Certificates, Declarations Of Conformity, Hygienic Certificates, Etc., Other Elements Of Small Architecture And Alley Surfaces, Before Installation.4 ) After Completion Of Construction Works, The Contractor Is Obliged To Commission An Inspection Of The Playground By A Certified Company At His Own Expense. The Inspection Should Be Carried Out By An Inspection Body That Meets The Requirements Of The Pn-En Iso/Iec 17020:2012 Conformity Assessment Standard. The Inspection Includes The Assessment Of Compliance Of Devices And Safe Surfaces With Applicable Standards, As Described In The Design Documentation. The Post-Assembly Inspection Covers All Elements Of The Playground (Which Are Within The Contractors Scope Of Work), Along With Checking The Depreciation Of The Safe Surface Under The Playground Equipment. It Is Required To Provide The Ordering Party With A Certificate Indicating The High Safety Of The Playground Along With An Inspection Report. This Document Is One Of The Elements Of The As-Built Documentation, Necessary For The Final Acceptance Of The Works.5) In The Event Of Additional, Replacement, Abandoned Works Or Extension Of The Scope Of The Contract, Settlement Will Be Made Based On The Unit Prices Given In The Offer Cost Estimate Constituting Annex No. 2 To The Contract In The Absence Of Appropriate Items In The Offer Cost Estimate Based On The Krn And Average Prices Of The Current Sekocenbud Price List Or The Manufacturers/Wholesalers Offer.6) Conducting Works While Maintaining Special Protection Of The Green Area. Excessive Damage To The Lawn Is Unacceptable. A Detailed Description And Scope Of Works Are Set Out In Annex No. 9 To The Swz: A) Description Of The Subject Of The Order (Opz); B) Executive Design) Technical Specification For The Execution And Acceptance Of Construction Works; 2. Additional Obligations Of The Contractor Resulting From The Social Clause Pursuant To Art. 95 Section 1 Of The Public Procurement Act, The Ordering Party Requires That The Contractor Or Subcontractor Employs On The Basis Of An Employment Relationship Within The Meaning Of Art. 22 § 1 Of The Act Of June 26, 1974, Labor Code (Consolidated Text: Journal Of Laws Of 2022, Item 1510, As Amended) Employees/Employees Directly Performing Activities Related To, Among Others: Construction Of Mineral Surfaces, Assembly Elements Of Small Architecture. The Above Condition Will Be Met By Employing New Employees/Employees Under An Employment Contract Or Appointing Employees/Employees Already Employed By The Contractor Or Subcontractor To Complete The Order.
