Globally, 27.6 Million People Were In Forced Labour According To The Global Estimates On Modern Slavery 2021 Produced By The International Labour Organization (Ilo), International Office For Migration (Iom) And Walk-Free Foundation. In Malaysia, Although There Are No National Estimates On Forced Labour Across Sectors, Reports Of Such Issue Occurring In The Plantations, Manufacturing, Domestic Work, Construction And Services Have Prompted The Malaysian Government To Respond With Legislative Changes And Development Of New Policies. The Government-Led Employment Survey In Plantations 2018 Revealed That 8 In 1000 Workers In The Palm Oil Industry (5 Years And Older) Were In Forced Labour, With Migrant Workers Being Particularly Vulnerable (1.4%) As Compared To Malaysian Citizens (0.10%). The Age Group 5 17 Years Accounted For 10.6% Of The Total Number Of Those In Forced Labour. Based On The Results Of The Survey, It Is Estimated That 33,600 Children In Palm Oil Households Were Working Within The Definition Of Child Labour. Various Reports Suggest That Plantation Workers, Including Women Workers Are Often Engaged In Insecure Forms Of Work And Endure Discrimination And Substandard Working And Living Conditions. Palm Oil Produced In Malaysia Has Been Included In The 2020 Us Department Of Labour List Of Goods Produced By Child Labour Or Forced Labour. MalaysiaS Commitment To Eradicate Forced Labour Is Seen In Its Ratification Of The Ilo Forced Labour Protocol 2014 On 21St March 2022 And The Adoption Of The 2021-2025 National Action Plan On Forced Labour (Napfl) In November 2021 Under The Leadership Of The Ministry Of Human Resources, And The 2021-2025 National Action Plan On Trafficking In Persons (Naptip 3.0) Under The Anti-Trafficking In Persons And Anti-Smuggling Of Migrants Council (Mapo). The National Action Plan On Child Labour (Napcl) Is Also Under Development Under The Leadership Of Mohr. The Napcl Will Likewise Serve As The Umbrella Nap For All Interventions Addressing The Full Range Of Child Labour Issues, Including Those That Have Been Mainstreamed In Other Relevant Naps. The Napfl And Naptip Set Comprehensive Frameworks For Initiatives By The Government, Workers And Employers Organisations, The Civil Society Organisations, And International Industry Associations To Achieve Elimination Of Forced Labour And Human Trafficking By 2030. This Is Also In Line With The Sustainable Development Goal Target 8.7 To Take Immediate And Effective Measures To Eradicate Forced Labour, End Modern Slavery And Human Trafficking And Secure The Prohibition And Elimination Of The Worst Forms Of Child Labour, Including Recruitment And Use Of Child Soldiers, And By 2025 End Child Labour In All Its Forms. The Relevant Strategic Goals Of The Napfl Are As Follows: Strategic Goal 1 Of The Napfl Is Focused On Raising Awareness About Forced Labour Among Key Target Groups, Including Workers And Employers And Increasing The Knowledgebase On Forced Labour In The Country. Strategic Goal 1.1: Workers And Employers Have Increased Knowledge On Forced Labour And Are Better Able To Combat Forced Labour, Including In The Supply Chains Activities: Implement Targeted Awareness Raising To Support The Implementation Of The Other Napfl Interventions, E.G. Awareness About Freedom Of Association And How It Protects Workers Against Forced Labour, Awareness To Employers About Due Diligence And Remediation Responsibilities And Gender Dynamics In Forced Labour. Disseminate Information Materials To Workers And Employers About Atipsom Act And Labour Laws Relating To Forced Labour And Child Labour. Develop Communication Strategy Including Dissemination Plan For Informational Materials That Are Simple And Easy To Understand, Taking Into Consideration Workers Literacy, Gender Needs And Other Important Factors. Strategic Goal 1.2: The General Public (Community Key Stakeholders) Have Increased Knowledge On Forced Labour And Are Better Able To Take Action Against It Activities: Implement Awareness-Raising Targeted To Increase The PublicS Knowledge About Indicators Of Forced Labour And How To Report These Cases Hold Town-Hall Meetings And Other Events To Raise Awareness And Mobilise Malaysian And Migrant Communities And Other Stakeholders Including Embassies To Participate In Action Against Forced Labour, With Consideration Of Hybrid Meetings Where Outreach Even To The Undocumented Population Is Made Possible (For Example, Face-To-Face With Online Options). Awareness-Raising Targeted To Increase The PublicS Knowledge About Indicators Of Forced Labour And How To Report These Cases. Strategic Goal 2.7 Of The Napfl Is Focused On Empowering Communities To Participate In The Goal Of Eradicating Forced Labour, And States Reporting Of Forced Labour From The Public Encouraged. Develop Programme For Whistle Blowers, Informers And Human Rights Defenders As Means To Get Information On Forced Labour Including Establishing Special Funds For Informers Whose Identity Remains Confidential, And To Verify Information Received From These Parties Currently, The Legal Framework In The State Of Sabah Does Not Provide For The Offence Of Force Labour, However The Employment Act 1950, Effective In Peninsular Malaysia, Has Been Amended To Provide For The Same. With A View Towards The Future Amendment Of The Sabah Labour Ordinance To Incorporate This Offence, And The Concerted International Efforts To Move Towards Sustainable Production Of Palm Oil Products, The Ilo, With Development Cooperation Assistance From The Us Department Of State Bureau Of Democracy, Human Rights And Labor (Usdos Drl) Through The Project Advancing Workers Rights In The Palm Oil Sector In Indonesia And Malaysia (Hereinafter Referred To As The Project), Is Conducting Awareness-Raising Activities In Respect Of Forced Labour, Child Labour And Labour Trafficking To Contribute To Strategic Goal 1 Of The Napfl. The Project Has Also Developed A Draft Labour Grievance Referral Form, To Be Refined And Implemented In Consultation With Key Community Stakeholders In Sabah, To Contribute To Strategic Goal 2.7 Of The Napfl. This Tor Reflects The Basic Requirements For The Implementation Of Both The Awareness-Raising Activities And The Implementation Of The Labour Grievance Referral Form With The Objective Of Improving Awareness Regarding Forced Labour, Child Labour And Labour Trafficking, And Improving Access To The Existing Labour Grievance Redressal Mechanisms, Particularly In Remote Areas Of Sabah. This Is With The Understanding That The Implementation And Monitoring Of Napfl Requires Participation Of Multiple Agencies Of The Government, Employers Organizations, Trade Unions, Workers, Civil Society And General Public. Scope Of Work Outputs The Contractor Is Expected To Deliver The Following Outputs: 1. Convene Community-Based Awareness-Raising Activities To Sensitise Communities To And To Improve The Understanding Of Forced Labour, Child Labour, Human Trafficking And The Fundamental Principles And Rights At Work, The Key Beneficiaries Of Which Should Be Employers, Workers And Members Of The Public, Targeting 1000 Individuals In Each Of The Following Districts In Sabah: A. Kinabatangan B. Sandakan C. Keningau D. Semporna E. Lahad Datu F. Tawau 2. As Part Of The Awareness-Raising Activities In Item 1 Above, To Disseminate Awareness-Raising Materials Developed By The Project To The Abovenamed Key Beneficiaries In Sabah. 3. Conduct Consultations With District Offices, District- And Headquarters-Level Labour Offices And District-Level Community Leaders In The Abovementioned Districts Regarding The Draft Labour Grievance Referral Form Developed By The Project, To Assess Its Viability And, In Consultation With The Project Team, Effect Any Refinements As May Be Necessary To Implement The System. 4. In Cooperation With The Sabah Department Of Labour, Implement The Labour Grievance Referral Form System And Monitor The Progress Thereof By Way Of Follow-Up With The Relevant District-Level Authorities, Including But Not Limited To, District-Level Labour Departments, The District Offices And Community Leaders. Convene And Conduct Consultations With The Identified Community Leaders, Along With Key Contacts From The Relevant District Offices And Labour Department Offices To Assess The Viability Of The Draft Labour Grievance Referral Form. 3. With The Support Of The Project Officer And/Or The National Project Coordinator, Refine The Draft Labour Grievance Referral Form Based On The Inputs And Feedback From The Abovementioned Parties. 4. Coordinate With The Sabah Labour Department And The District-Level Community Leaders To Pilot The Implementation Of The Labour Grievance Referral System. 5. Monitor The Implementation Of The Labour Grievance Referral System, Gathering The Relevant Data To Assess Its Efficacy And Reach In Improving Access To Labour Grievance Redressal Processes. B.
